What is the 3.5 HPRD requirement in New York?

New York Public Health Law requires nursing homes to deliver a minimum of 3.5 hours of nursing care per resident per day and that every quarter with set minimums for RN, LPN, and CNA hours.

Do agency staff hours count toward HPRD?

Yes. Temporary, agency, contract, or per diem nurse and aide hours count toward your facility's average as long as they are properly captured in your PBJ submissions for the quarter.

Can a staffing contract reduce a DOH penalty?

DOH considers documented recruitment efforts during the quarter when determining the penalty. A signed staffing agreement and documented fill activity is evidence of good-faith recruitment efforts to close a gap.
